Taking out a Grant of Probate (or Letters of Administration where there is no Will) can be a simple, or complex matter. Whichever, we can take the burden from the Executors houlders and carry out what is often an extensive paper trail which the Executor may find time consuming and a worrying undertaking. We regularly act as Executors appointed under a Will, as well as acting for non-solicitor Executors and our work and advice would cover the taking out of the Grant of Probate, the gathering in of the assets, ascertaining any tax payable, whether it is Income Tax, Capital Gains Tax or Inheritance Tax as well as checking with the Benefits Agency that no State Benefits are refundable. This is one of a number of traps for the unwary Executor that we can help avoid. Missing Beneficiaries can sometimes be a problem.
We set out the basis of our fees before commencing work and it is always possible for an Executor to instruct us to undertake certain aspects of the administration of an Estate where they feel that they need some advice but are happy to undertake some of the work themselves.
